RésuméCet article a été inspiré par l'opposition qui semble exister entre les deux grands courants animant l'œuvre de M. Bachelard.Les auteurs rappellent la différence existant entre une organisation predicative et une organisation dialectique de la connaissance. La connaissance objective est de structure dialectique. Il en résulte que l'évolution de cette connaissance s'accompagne d'un processus obligé de dévalorisation et de revalorisation relative de ses formes antérieures.Ce même processus rend aussi compte des rapports de la pensée poétique et de la pensée objective (...) et scientifique.Dans cette perspective, l'unité d'inspiration de l'œuvre de M. RésuméExiste‐t‐il une Méthode selon laquelle les résultats de la recherche dans une discipline telle que les mathématiques peuvent être intégrés à la recherche philosophique? Cette question est traitée à l'aide de trois exemples: celui de la philosophie cartésienne, celui de l'empirisme logique et finalement celui de la philosophie ouverte.Une seule et même procédure méthodologique se dégage d'ailleurs à toute autre tentative d'intégrer les résultats d'une recherche scientifique à la philosophie. Elle est essentiellement la suivante:Une telle procédure n'est valable que si (...) l'idée de justesse fait son entrée dans la philosophie. Une philosophie qui s'établit dans une intention de justesse s'engendre et s'organise en une perspective mentale telle que le savoir assuré y trouve sa place légitime. Le savoir n'y entre d'ailleurs que sous la forme d'hypothèses à faire valoir, d'hypothèses éprouvées et non totalement certaines.La philosophie cartésienne et la doctrine de l'empirisme logique sont à rejeter parce qu'elles proposent chacune pour son compte une conception des mathématiques que la recherche réelle ne confirme pas.La philosophie ouverte cherche au contraire à en tenir compte dans la conception des mathématiques qu'elle prétend engager dans une perspective philosophique adéquate, des résultats les plus récents de la recherche sur les fondements et la méthode des mathématiques. The author first investigates how to precise and get to the core of the sense of a word in common language. Any definition, however appropriate it may seem, is in fact inadequate. The word must be considered as a moment of a precising activity, which is particularly clear in the case of analogy as a word and an idea. With that in view, the concept of the scheme is explained and it is examined in which horizon a mental scheme may (...) have an existence of its own. In order to provide a satisfactory answer, it is necessary to investigate and uncover the structure of subjectivity, to make it understood that the basic principles of mathematics arise from elaborating some of these disciplines in relation with a scheme.Two fields of existence may then be said analogous if they may be considered as two different realisations of a scheme. The views gained in investigating the structures of subjectivity permit to realize how the result may be extended to mathematical models and how the part played by those mathematical models may be precised. The use of biotechnology in food productiongives rise to consumer concerns. The term ``consumerconcern'' is often used as a container notion. Itincludes concerns about food safety, environmental andanimal welfare consequences of food productionsystems, and intrinsic moral objections againstgenetic modification. In order to create clarity adistinction between three different kinds of consumerconcern is proposed. Consumer concerns can be seen assigns of loss of trust. Maintaining consumer trustasks for governmental action. Towards consumerconcerns, governments seem to have limitedpossibilities for public policy. Under current (...) WTOregulations designed to prevent trade disputes,governments can only limit their policies to 1) safetyregulation based upon sound scientific evidence and 2)the stimulation of a system of product labeling. Ananalysis of trust, however, can show that ifgovernments limit their efforts in this way, they willnot do enough to avoid the types of consumer concernsthat diminish trust. The establishment of a technicalbody for food safety – although perhaps necessary –is in itself not enough, because concerns that relatedirectly to food safety cannot be solved by ``pure''science alone. And labeling can only be a good way totake consumer concerns seriously if these concerns arerelated to consumer autonomy. For consumer concernsthat are linked to ideas about a good society,labeling can only provide a solution if it is seen asan addition to political action rather than as itssubstitution. Labeling can help consumers take uptheir political responsibility. As citizens, consumershave certain reasonable concerns that can justifiableinfluence the market. In a free-market society, theyare, as buyers, co-creators of the market, andsocietal steering is partly done by the market.Therefore, they need the information to co-create thatmarket. The basis of labeling in these cases, however,is not the good life of the individual but thepolitical responsibility people have in their role asparticipants in a free-market. Then, public concernsare taken seriously. Labeling in that case does nottake away the possibilities of reaching politicalgoals, but it adds a possibility. (shrink)

Archaeological excavations carried out at Pentridge Prison discovered the ruins and foundations of three panopticon exercise yards. This paper details the scope and observations of the excavation program and discusses the influence of Jeremy Bentham’s panopticon model on penal reform and prison design in Australia in the middle of the 19th Century.

The defining principle of evolutionary biology is that all species, extant and extinct, evolved from ancient prokaryotic cells. Their initial appearance and adaptive evolution are proposed to have been accompanied by a cellular sentience, by feelings, subjectivity or, in a word, 'consciousness'. Prokaryotic cells, such as archaea and bacteria, have natural unitary, valence-marked 'mental' representations. They process and evaluate sensory information in a context-dependent manner. They learn, establish memories, and communicate using biophysical fields acting on excitable membranes. Symbiotic eukaryotic cells, (...) which evolved much later, initiated a compound cellular subjectivity utilizing 'senomic' and 'ephaptic' principles that evolved into the varieties of consciousness seen in multicellular species. This Cellular Basis of Consciousness (CBC) model provides a novel framework within which to approach fundamental issues such as the origins of life and the emergence of mind. (shrink)

Background:Surveillance technology such as tag and tracking systems and video surveillance could increase the freedom of movement and consequently autonomy of clients in long-term residential care settings, but is also perceived as an intrusion on autonomy including privacy.Objective:To explore how clients in residential care experience surveillance technology in order to assess how surveillance technology might influence autonomy.Setting:Two long-term residential care facilities: a nursing home for people with dementia and a care facility for people with intellectual disabilities.Methods:Ethnographic field study.Ethical considerations:The boards (...) representing clients and relatives/proxies of the clients were informed of the study and gave their written consent. The clients’ assent was sought through a special information leaflet. At any time clients and/or proxy were given the option to withdraw from the study. The research protocol was also reviewed by a medical ethics committee.Findings:Our findings show a pattern of two themes: (1) coping with new spaces which entailed clients: wandering around, getting lost, being triggered, and retreating to new spaces and (2) resisting the surveillance technology measure because clients feel stigmatized, missed the company, and do not like being “watched.”Conclusion:Client experiences of surveillance technology appear to entail a certain ambivalence. This is in part due to the variety in surveillance technology devices, with each device bringing its own connotations and experiences. But it also lies in the devices’ presupposition of an ideal user, which is at odds with the actual user who is inherently vulnerable. Surveillance technology can contribute to the autonomy of clients in long-term care, but only if it is set in a truly person-centered approach. (shrink)

In the Laura Ashworth case in 2008, the Human Tissue Authority considered itself bound to overturn a deceased daughter's alleged wish that one of her kidneys should go to her mother, who at the time had end stage kidney failure and was on dialysis. 12 This was so even though Laura's earlier wish to be a living donor would most likely have been authorised, had the formal assessment process begun.
